    This Agreement, sets forth the terms and conditions that apply to use ofthis site (www.techfino.in) and all sub sites that reside under the site(collectively “TCPL Sites”), by a Subscriber. “Subscriber” means each personwho establishes or accesses a connection (“Account”) for access to and use ofthe TCPL Sites.

    Restrictions On Use

    The TCPL Sites are owned and operated by Techfino Capital PrivateLimited (“Company”) and contains material which is derived, in whole or inpart, from material supplied by the Company, its group companies, various newsagencies and other sources (including content partners), and is protected byinternational copyright and trademark laws. The restrictions on use of thematerial and content on the TCPL Sites by the Subscriber are specified below.Except where specifically authorised, the Subscriber may not modify, copy,reproduce, republish, upload, post, transmit or distribute in any way anymaterial from the TCPL Sites including code and software.

    By using the TCPL Sites, Subscriber agrees to comply with all of theterms and conditions hereof. The right to use the TCPL Sites is personal toSubscriber and is not transferable to any other person or entity. Subscriber isresponsible for all use of Subscriber’s Account (under any screen name orpassword) and for ensuring that all use of Subscriber’s Account complies fullywith the provisions of this Agreement. Subscriber shall be responsible forprotecting the confidentiality of Subscriber’s password(s), if any.

    The Company shall have the right at any time to change or discontinueany aspect or feature of TCPL Sites, including, but not limited to, content,hours of availability and equipment needed for access or use.

    Changed Terms

    The Company shall have the right at any time to change or modify theterms and conditions applicable to Subscriber’s use of the TCPL Sites, or anypart thereof, or to impose new conditions, including but not limited to, addingfees and charges for use. Such changes, modifications, additions or deletionsshall be effective immediately upon notice thereof, which may be given by anymeans, including but not limited to, posting on the TCPL Site, or by electronicor conventional mail, or by any other means by which Subscriber obtains noticethereof. Any use of the TCPL Site by Subscriber after such notice shall bedeemed to constitute acceptance by Subscriber of such changes, modifications oradditions.

    Equipment

    Subscriber shall be responsible for obtaining and maintaining alltelephone, computer hardware and other equipment needed for access to and useof the TCPL Sites and all charges related thereto.

    Disclaimer OfWarranty: Limitation Of Liability

    Subscriber expressly agrees that use of TCPL Sites is at Subscriber’ssole risk. Neither the Company, its affiliates nor any of their respectiveemployees, agents, third party content providers or licensors warrant thatITCPL Sites will be uninterrupted or error free; nor do they make any warrantyas to the results that may be obtained from use of TCPL Sites, or as to theaccuracy, reliability or content of any information, service, or merchandiseprovided through TCPL Sites.

    TCPL Sites is provided on an “As Is” basis without warranties of anykind, either express or implied, including, but not limited to, warranties of titleor implied warranties of merchantability or fitness for a particular purpose,other than those warranties which are implied by and incapable of exclusion,restriction or modification under the laws applicable to this agreement.

    This disclaimer of liability applies to any damages or injury, caused byany failure of performance, error, omission, interruption, deletion, defect,delay in operation or transmission, computer virus, communication line failure,theft or destruction or unauthorized access to, alteration of, or use ofrecord, whether for breach of contract, tortious behavior, negligence, or underany other cause of action. In no event will the Company, or any person orentity involved in creating, producing or distributing TCPL Sites or the TCPL Sitessoftware, be liable for any damages, including, without limitation, direct,indirect, incidental, special, consequential or punitive damages arising out ofthe use of or inability to use TCPL Sites. Subscriber hereby acknowledges thatthe provisions of this section shall apply to all content on TCPL Sites.

    In addition to the terms set forth above neither the Company, nor itsaffiliates, information providers or content partners shall be liableregardless of the cause or duration, for any errors, inaccuracies, missions, orother defects in, or inauthenticity of, the information contained within TCPLSites, or for any delay or interruption in the transmission thereof to theuser, or for any claims or losses arising therefrom or occasioned thereby. Noneof the foregoing parties shall be liable for any third-party claims or lossesof any nature, including, but not limited to, lost profits, punitive orconsequential damages. The Company, its affiliates, information providers orcontent partners shall have no liability for investment decisions based on theinformation provided. Neither, the Company, nor its affiliates, informationproviders or content partners warrant or guarantee the timeliness, sequence,accuracy or completeness of any information.

    As per the Fair Practices Code adopted by the Board of Directors of Techfino Capital Private Limited (TCPL), a Grievance Redressal Procedure is being outlined as below.

    Escalation Matrix

    In case the customer does not receive a response within 14 working days or if the customer is dissatisfied with the response received from the Company, customer may escalate the complaint to the next level as indicated below.

    Primary Level:

    If the customer is not satisfied with the resolution received from above channels, or if the customer does not hear from us in 14 days, the customer can write to the Nodal Officer Mr. Braja Kishore Sahu at customercare@techfino.in.

    Customers are required to quote the complaint reference number provided their earlier interaction, along with their loan account number to help us understand and address their concerns.

    An assurance is given to the customer that he would receive a response within 14 business days and due efforts will be taken to resolve the complaint well before that.

    Secondary Level:

    If the customer is not satisfied with the resolution received or if the customer does not hear from us in 30 days, then he may escalate his grievance to the regulator at the below address:

  • PREAMBLE

    Techfino Capital Private Limited (“TCPL”) is a Non-Banking Financial Services company providing  end use ensured consumer lending. TCPL provides consumers loans through selected partners.

    SCOPE

    This Code is a voluntary code adopted by TCPL with the aim to achieve best practices while dealing with its Customers.

    This code is applicable from the date it is adopted by TCPL’s Board. It will be updated from time to time and will be made available publicly at TCPL’s website.

    DEFINITIONS

    Borrower means any person applying to borrow funds from TCPL

    Partner means the retailer / seller, whose product / services are purchased by the Borrower

    Terms and Conditions means the terms and conditions applicable to the loan and is binding on the customer and TCPL

    TCPL means “Techfino Capital Private Limited”, a company incorporated under the Companies Act, 2013 in India whose registered office is at 17065, Prestige Shantiniketan, Mahadevapura, Whitefield, Bangalore - 560048.

    DECLARATION

    TCPL declares and undertakes the following

    To provide in a professional manner, efficient diligent and seamless speedy service to its borrowers.

    To not discriminate on the basis of religion, caste, sex, descent etc. among its Members

    To be fair and honest in all the advertisements and marketing efforts.

    To provide its borrowers with accurate and timely disclosure of Terms, costs, rights and liabilities as regards loans availed from TCPL.

    To attempt in good faith to resolve any disputes with the borrowers by setting up complaint redressal cells within the organization.

    To comply with all the regulatory legal requirements in good faith.

    LOAN APPLICATION

    All communications to the Borrower shall be in English.

    All documentations and terms and conditions, including details on the website such as the privacy policy, User Terms, etc. shall be maintained in English.

    Users using translation services while using the Platform will do so at their own risk as TCPL does not guarantee that the translation provided will be accurate and urges borrowers to view the website in English.

    TCPL does not have a physical loan application form. TCPL’s loans are originated at the point of sales of the retailer and basic information pertaining to the customer is collected.

    Link is sent to the borrower for accepting the terms and conditions, payment of processing fee and uploading of KYC documents.

    A detailed terms and conditions is provided by TCPL, which is to be accepted by the borrower during the onboarding process on the Website. TCPL strongly urges the borrowers to obtain appropriate independent professional advice when in doubt while applying and processing the loan with TCPL

    An email and SMS confirmation shall be provided to the borrower acknowledging the receipt of the loan application/registration on its website. Borrowers can have full details of method of application of interest, wherever applicable.

    The Borrower would be informed of the procedure involved in servicing of the loan through email.

    Upon closure of the loan the borrower will receive a no dues certificate by email.

    LOAN APPRAISAL AND TERMS &CONDITIONS

    TCPL will send the loan confirmation letter to the borrower, after completion of KYC, by email

    The letter will comprise information on the loan amount, tenor, repayment schedule including EMI, interest rate, fees, penalties etc. It will also inform about the contact details of TCPL for queries and complaints

    The Borrower is given an option to register for an online account, where he / she can keep track of the payments made, repayments due etc.

    DISBURSEMENT OF LOANS INCLUDING CHANGES IN TERMS &CONDITIONS

    Disbursement will be done to the Partner’s account on behalf of the Borrower.

    Any changes in the interest rates and charges shall be effected prospectively.

    All borrowers need to meet the eligibility criteria as approved by the board of directors of TCPL

    The Board of Directors of TCPL shall at all times review the eligibility criteria in consonance with the law as well as determine the pricing of services provided by it as per the market rate.

    The Board of Directors shall formulate rules, which may be amended from time to time, that ensures that loans are processed on equitable and non- discriminatory manner.

    REFUND AND CANCELLATION POLICY

    Cancellations/Pre-closures/Refunds if any, as applicable will be guided by terms and conditions stated in Sanction Letter / Borrower Agreement accepted by the Borrower at the time of availing the loan and internal approvals.

    GENERAL

    TCPL will not interfere in the affairs of the Borrower except for the purposes provided in the terms and conditions of the loan.

    Actions taken for the approval or rejection of loans, and actions taken on request from the Borrower for transfer of borrowed amount to another NBFC/FI, shall be conveyed to the Borrower within 21 days of receipt of application/request. Such transfer shall be effected as per transparent contractual terms in consonance with law.

    TCPL shall not resort to undue harassment for the recovery of loans, viz. persistently bothering the borrowers at odd hours, use of muscle power for recovery of loans etc.

    For the loans with subvention, TCPL will not charge any foreclosure charges / prepayment penalties and the same would be conveyed to the customer.

    REGULATION OF INTEREST RATES

    TCPL’s Board of Directors will lay out appropriate internal principles and procedures in determining interest rates and processing and other charges from time to time. TCPL will be transparent in respect of the terms and conditions of the loans disbursed. Any grievance regarding excessive interest rates, penalties or charges may be addressed to the Grievance Redressal Officer mentioned on the Website.

    The Board of Directors of TCPL shall to adopt an interest rate model taking into account relevant factors such as, cost of funds, margin and risk premium, etc. and determine the rate of interest to be charged (wherever applicable), for loans and advances.

    The rates of interest and the approach for gradation of risks shall be made available on the Website. The information published on the website is be updated whenever there is a change in the rates of interest.

    The rate of interest adopted by TCPL will be annualized rates so that the Borrower is aware of the exact rates that would be charged to the account.

    CONFIDENTIALITY

    All personal information of the customer would be confidential and would not be disclosed to any third party unless agreed to by the Customer. The term 'Third party 'excludes all Law enforcement agencies, Credit Information Bureaus, Reserve Bank of India and other regulators, other banks/ financial and lending institutions.

    Subject to above Para, customer information would be revealed only under the following circumstances:

    If TCPL is compelled by law

    If it is in the Public Interest to reveal the information

    If the interest of TCPL requires such disclosure.

    GRIEVANCE REDRESSAL MECHANISM

    TCPL will have a Grievance Redressal Officer within the organization and would ensure that the Website would contain all the required relevant details, namely

    Response to a complaint whether positive or negative or requiring more time for redressal would generally be given within a maximum period of one month from the date of receipt of complaint, unless the nature of complaint is such that requires verification of voluminous facts and figures.

    TCPL would adequately train the operational staff to give patient hearing to the Borrowers in financial distress and would try to render such help as may be possible in their view.

    The Reserve Bank of India neither accepts any responsibility nor guarantees the present position as to the financial soundness of TCPL or for the correctness of any of the statements or representations made or opinions expressed by the company and for discharge of any liability by TCPL.

    Neither there is any provision in law to keep, nor does the company keep any part of the deposits with the Reserve Bank of India and by issuing a Certificate of Registration to the Company, the Reserve Bank of India, neither accepts any responsibility nor guarantees the payment of deposits to any depositor or any person who has lent any sum to TCPL.
